FEES
You acknowledge that J-ARM INVESTMENTS, LLC reserves the right to charge for access to the Website and to change such fees from time to time in its discretion. If J-ARM INVESTMENTS, LLC terminates your Account because you breach these Terms of Use, you shall not be entitled to a refund of any unused portion of subscription fees paid.
J-ARM INVESTMENTS, LLC may also charge additional fees to post Content in some areas of the Website. The fee is an access fee permitting Content to be posted in a designated area. Each user uploading, publishing, or displaying Content on the Website is responsible for said Content and compliance with these Terms of Use. All fees paid are non-refundable even in the event that Content is removed from the Website.
You agree that if actual damages cannot be reasonably calculated, you shall be liable to J-ARM INVESTMENTS, LLC for the following amounts under the following circumstances:
• One Thousand Dollars ($1,000.00) for each message that (a) fraudulently impersonates a person or entity, (b) falsely represents a user’s affiliation with a person or entity or (c) includes personal information about another person without that person’s prior written consent;
• One Hundred Dollars ($100.00) for each time you access the Website after J-ARM INVESTMENTS, LLC has terminated your ability to use the Website;
• Twenty-Five Dollars ($25.00) for each unsolicited email advertisement sent to J-ARM INVESTMENTS, LLC or other users;
• One Hundred Dollars ($100.00) for Content uploaded, displayed, or published in violation of these Terms of Use; and
• Three Thousand Dollars ($3,000.00) for each day you display, copy, reproduce, or otherwise exploit any Content (except your own Content) in violation of these Terms of Use without J-ARM INVESTMENTS, LLC’s express written permission.
Otherwise, you shall pay to J-ARM INVESTMENTS, LLC the actual damages caused by any of the above violations. Notwithstanding any other provisions of these Terms of Use, J-ARM INVESTMENTS, LLC retains the right to seek specific performance of any term contained in these Terms of Use and any other legal remedy available to J-ARM INVESTMENTS, LLC.
If you violate these Terms of Use, no further warnings shall be issued by J-ARM INVESTMENTS, LLC. J-ARM INVESTMENTS, LLC may immediately institute the above fines and/or seek the appropriate legal remedies.
PASSWORDS
All Accounts are password protected. When creating an Account, you will be prompted to choose a username and password. You must not disclose your username or password to any third party or permit any third party to use your username or password. You are solely responsible for maintaining the confidentiality of your username and password and for any and all activities that occur under that name and password. You shall immediately notify J-ARM INVESTMENTS, LLC if you have any suspicion that an unauthorized party is accessing your Account. You may change your password at any time.
